HOW TO ENTER: Visit www.SanLuisObispo.com/realestate and fill out and submit the online entry form. Sweepstakes begins 12:01 a.m. PT on July 27, 2008 and ends 9:00 am p.m. PT on September 18 2008 (the “Sweepstakes Term”). To qualify for a chance to win, your entry must be received online at www.SanLuisObispo.com, by 9:00 p.m. PT on September 18, 2008. Sponsor is not responsible for late, lost, incorrect or misdirected entries. All entries become the exclusive property of the Sponsor and will not be returned to entrants. Sponsor may use the information on entries for marketing purposes. Limit: one entry per person/household. In the case of multiple entries, only the first entry will be accepted. Entrants need not be present to win.
ELIGIBILITY: Sweepstakes open to individuals 18 years of age or older as of July 27, 2008, and who are legal residents of California. Employees, contractors and directors of Sponsor, and any of their parents, subsidiaries, affiliates, advertising, production and promotion agencies, and the immediate families and members of the same household of each, are not eligible. Sweepstakes void wherever prohibited by law. All federal, state and local laws and regulations apply. By participating in this Sweepstakes, each entrant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of the Sponsor on all matters relating to the Sweepstakes, including determination of the prize winner, and warrants that she/he is eligible to participate in this Sweepstakes. By participating in this Sweepstakes, each entrant agrees that any and all disputes which cannot be resolved between the parties shall be resolved exclusively before a court located in the City of San Luis Obispo, CA having competent jurisdiction, which court shall apply the laws of the State of California without regard for doctrines of conflicts of law. Further in any such dispute, under no circumstances will entrant be permitted to obtain awards for, and hereby waives all rights to claim, special, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than entrant’s actual out-of-pocket expenses (i.e., costs associated with entering the Sweepstakes), and entrant further waives all rights to have damages multiplied or increased. By accepting the prize, winner agrees to release Sponsor and the participating stores, and any of their parents, subsidiaries and affiliates, and each of their directors, employees, officers, and agents, including without limitation, its advertising and promotion agencies, from any and all liability, injuries, loss or damages of any kind, including without limitation death and property, arising from or in connection with the awarding, receipt, and/or use or misuse of prize, participation in any prize-related activities or participation in the Sweepstakes.
PRIZE: Four total Prizes will be awarded for the Sweepstakes. Three of the four Prizes are composed of (1) $50 gas card and the fourth prize consists of (1) raffle ticket for a chance to win a 2008 SMART Car from CASA of SLO County, with an approximate retail value of $100. SMART Car raffle drawing will be held on September 20, 2008. Additional rules regarding the SMART Car may be found at www.slocasa.org//main.asp?id=22 . All taxes, incidentals and other expenses associated with prize and not specified herein are the winner’s sole responsibility. Restrictions may apply. Prize is not transferable or redeemable for cash. Sponsor reserves the right to substitute prize or items included in prize with one of equal or greater value in the event prize is unavailable. Acceptance of prize constitutes permission (except where prohibited) to use winner’s name, hometown, likeness and biographical information for purposes of advertising, promotion and publicity without additional compensation to winner.
WINNER SELECTION: Winners will be selected in a random drawing from all eligible entries received. Drawing to be conducted on August 7, August 21, September 4 and September 18, 2008 by Sponsor, whose decisions are final and binding on all matters relating to this Sweepstakes. Odds of winning depend on the total number of eligible entries received. Sweepstakes Prizes is guaranteed to be awarded. The winners will be notified by email to the email address or by phone to the phone number provided on the entry form. In the event that a winner does not respond to such notification within three days, a disqualification will result and an alternate winner will be selected in a random drawing from the remaining eligible entries. The winners will be required to complete and return an Affidavit of Eligibility/Release of Liability/Publicity Release which must be signed and received by Sponsor or its designated agent within at the time prize is claimed or an alternate winner will be selected in a random drawing from the remaining eligible entries. If any prize notification emails or any prizes are returned as undeliverable, the prize will be awarded to an alternate winner in a random drawing from all non-winning entries. Sponsor is not responsible for, and shall not be liable for, late, lost, misdirected or unsuccessful efforts to notify any winner.
CLAIMING PRIZE: Winners will be notified by email to the email address provided on the entry form or by phone. Winners must be 18 years of age as of July 27, 2008 and must present a valid California Driver's License when claiming prize. Prizes must be claimed in person at The Tribune's offices at 3825 S. Higuera Street, San Luis Obispo, CA 93406.
NAMES OF SWEEPSTAKES WINNERS: For the names of the Sweepstakes winners (available after Sept 21, 2008), send a self-addressed stamped envelope postmarked by September 29, 2008 to: Showcase GAS Saver Sweepstakes Winners, ATTENTION: Marketing, The Tribune, 3825 S. Higuera Street, San Luis Obispo, CA 93406. Requests for the name of the Sweepstakes winners will be fulfilled after the winner’s name has been verified.
